The Principle of the Separation of Powers

The separation of powers divides federal authority into three distinct branches:

  • Legislative Branch: Creates laws.

  • Executive Branch: Enforces laws.

  • Judicial Branch: Interprets laws.

This system creates checks and balances, allowing each branch to restrict the powers of the others and prevent authoritarian rule (Madison, 1788).

Executive Overreach and Judicial Challenges

A notably concerning example illustrating the tensions between the Executive and Judicial branches is the Trump administration's deportation of Venezuelan immigrants:

  • Deportation to El Salvador: Over 200 Venezuelan citizens, alleged members of the Tren de Aragua gang, were deported from Texas to El Salvador by the Trump administration despite explicit judicial orders that prohibited such actions due to humanitarian and legal concerns.
